TERMS AND CONDITIONS OF SALE

DAY TRIPS – THE CORNER BY MOOD OF BALI


1. COMPANY IDENTITY

These Terms and Conditions of Sale apply to the excursions offered by:

Hereinafter referred to as “the Agency”.


2. PURPOSE

These Terms and Conditions govern the sale of day trips, including activities, occasional transportation, guiding services, and/or local services.

These services are provided on a standalone and independent basis and do not under any circumstances constitute a package holiday, a full travel arrangement, or a comprehensive management of the Client’s trip.


3. BOOKING AND CONFIRMATION

Any booking is considered final and binding upon validation of the order and payment.

The booking implies full, complete, and unconditional acceptance of these Terms and Conditions.

No right of withdrawal applies after confirmation.


4. SERVICES

Only the services expressly stated as included at the time of booking are provided.

Any service not explicitly mentioned as included shall be considered excluded and remains the responsibility of the Client.


5. CANCELLATION POLICY

Any cancellation must be notified in writing, with email serving as proof.

For cancellations made up to 72 hours before the activity, 30% of the total amount will be retained, corresponding to costs incurred, and 70% will be refunded within 7 working days.

For cancellations made less than 72 hours before the activity, 100% of the amount is due and no refund will be issued.

These fees correspond to commitments made with local service providers as well as costs incurred by the Agency.

Any cancellation, regardless of the reason, including illness, delay, transport issues, or personal circumstances, will result in the application of these conditions.


6. CLIENT IMPEDIMENT

In the event of circumstances beyond the Client’s control, including flight cancellation or delay, transport issues, illness, or personal incidents preventing participation in the activity, the cancellation conditions remain applicable and the Agency cannot be held responsible.

However, as a commercial gesture and without obligation, the Agency may offer a rescheduling or a goodwill gesture depending on availability and the constraints of local service providers.


7. RESCHEDULING CONDITIONS

Any request for rescheduling must be made no later than 24 hours before the activity.

Rescheduling is not automatic and remains subject to prior approval by the Agency and to the availability of local service providers.

The Agency reserves the right to accept or refuse any request.

In exceptional circumstances such as adverse weather conditions, heavy rain, local alerts, or safety constraints, the activity may be rescheduled only with the agreement of the Agency and the service providers.

If rescheduling is not possible, a 30% fee will be retained.


8. TRANSPORT ORGANIZATION

Transportation is arranged based on local availability.

Vehicles may be private or shared.

For groups of five or more travelers, it cannot be guaranteed that all participants will be in the same vehicle.

For groups exceeding ten people, a specific organization must be arranged in advance.


9. MINORS

Children remain under the sole responsibility of their parents or accompanying adults.

The Agency cannot be held responsible in the event of lack of supervision.


10. INSURANCE

The Client acknowledges being personally responsible for their insurance coverage.

The Client agrees to hold insurance covering, in particular, medical expenses, hospitalization, repatriation, accidents, and the activities undertaken.

Certain bank cards or personal insurance policies may include such coverage. It is the Client’s responsibility to verify the terms.

In the event of an accident, injury, or health issue, only the Client’s personal insurance may be used.

The Agency declines all responsibility in the event of absence or insufficient coverage.


11. ACTIVITIES AND RISKS

Certain activities involve risks, including hiking, boating, snorkeling, and similar activities.

The Client acknowledges participating voluntarily, being in suitable physical condition, and agreeing to follow safety instructions.

The Client expressly releases the Agency from any liability in the event of an accident, injury, or damage.


12. LIMITATION OF LIABILITY

The Agency acts as an independent local service provider.

Its liability is strictly limited to the services expressly included.

It cannot be held responsible for bodily injury, illness, or accidents, loss or theft of personal belongings, delays related to traffic or local conditions, weather conditions, administrative decisions, third-party service providers, the Client’s behavior, or any external events beyond its control.

No compensation may be claimed for indirect damages or for changes beyond the Agency’s control.


13. UNFORESEEN EVENTS AND ADJUSTMENTS

Schedules and programs are provided for information purposes only.

Adjustments may be necessary due to weather conditions, traffic, local constraints, or external decisions.

The Agency will endeavor to offer a reasonable alternative solution, without any obligation of result.


14. FORCE MAJEURE

The Agency cannot be held responsible for total or partial non-performance of services in the event of circumstances beyond its control, including natural disasters, exceptional weather conditions, health incidents, political or social unrest, or government decisions.

In such cases, no compensation may be claimed.


15. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by Indonesian law.

Any dispute falls under the exclusive jurisdiction of Indonesian courts.


16. ACCEPTANCE OF TERMS

Any booking implies acceptance of these Terms and Conditions.
